Terms of Service

Dementia Lottery Scotland · Effective from publication date · This is the controlling, English-language version.

These Terms govern the purchase of tickets, the registration of entries, and your participation in the Dementia Lottery operated by Dementia Drive CIC. By purchasing a ticket and/or registering an entry on this site, you agree to these Terms.

1. Who we are

The Dementia Lottery (also referred to as “Dementia Lottery Scotland”) is operated by Dementia Drive CIC, a Scottish Community Interest Company (company number SC861664) (“we”, “our”, “us”). The Dementia Lottery is run under a Small Society Lottery licence issued by our Scottish licensing local authority and renewed annually.

2. Eligibility

  • You must be aged 16 or over to buy a ticket or register an entry. Sixteen is the legal minimum age for participation in a Small Society Lottery in Great Britain.
  • You must be physically present in Great Britain (England, Scotland or Wales) when you buy a ticket.
  • You must not be excluded from gambling by a court order, regulatory direction, or self-exclusion arrangement that applies to you.
  • Employees of Dementia Drive CIC, members of our governing body, and members of their immediate household, are not permitted to purchase tickets in any draw they are responsible for operating or supervising.

If we identify an entry made in breach of these eligibility rules, the entry will be void, the ticket cost will be refunded or directed to the cause, and any prize claim will be invalid.

3. How tickets are sold

  • Tickets are sold in person only, by our authorised vendors, at private venues with the express permission of the proprietor (such as pubs, clubs, hospitality venues, and approved events).
  • We do not sell tickets on the public street and we do not sell tickets online or via this website.
  • Tickets are sold at a fixed price of £10 each.
  • Each paper ticket carries a unique reference number, which must be entered on the ticket registration page to enter the draw.

This website is used only to (a) provide information about the Dementia Lottery, and (b) allow ticket holders to register their existing paper-ticket entry into the next draw. No payment is taken on this site.

4. Registering an entry

To be entered into a draw you must register your ticket on our entry registration page. We will ask for your first name, last name, mobile telephone number, optional email address, and the unique reference number printed on your paper ticket. By submitting the form you confirm that the information is accurate and that you meet the eligibility rules in Section 2.

5. The draw and the prize

  • Each draw will be conducted live on YouTube. Registered entrants will receive a text message containing the YouTube link before the draw begins.
  • The headline prize is £2,500, paid to one winner per draw. The prize is set aside before the draw is declared final.
  • The winner will be selected by a fair, transparent and randomised method on the live broadcast.
  • The winner will be contacted privately using the phone number and/or email address registered on the entry form. If the winner cannot be contacted within 14 days of the draw using reasonable efforts, we reserve the right to redraw or roll the prize into the next draw, at our discretion.
  • Prizes are non-transferable and there is no cash-equivalent alternative beyond the cash prize itself.
  • Players must be 16 or over at the time of the draw to claim a prize.

In accordance with Small Society Lottery rules:

  • At least 20% of proceeds are applied to the cause — in practice we always exceed this.
  • Single prizes are capped at £25,000.

6. Refunds and cancellations

We will refund a ticket up until the draw closes if there is a legitimate reason, including:

  • The ticket was bought in error.
  • The ticket was sold to a person aged under 16.
  • The ticket number is illegible or duplicated.
  • An operational issue with the draw has occurred which is materially attributable to us.

Once the draw has been made, the result is final. No refund can be given after the draw has taken place except where required by law.

If a draw is rescheduled for genuine operational reasons, every entrant will be notified by text and email and offered either (a) re-entry into the next draw, or (b) a full refund.

7. Use of vendors

Our authorised vendors operate under a written services agreement with Dementia Drive CIC. They are adults, they carry identification, and they only sell on private property with the express permission of the proprietor. Vendors receive a fair commission per sale — this is a transparent part of our social-enterprise model and is disclosed publicly on our website.

8. Where the money goes

From each £10 ticket, we apply funds to: (a) the headline prize, (b) a small vendor commission, (c) necessary running costs such as ticket printing and postage, and (d) the cause — funding free wheelchair-adapted transport and related services for people living with dementia and their families, plus the wider community-benefit objectives of Dementia Drive CIC. There are no dividends, no private profit, and no leadership compensation. The CIC asset lock and our Permanent Charter make this enforceable.

9. Your personal data

How we collect, use and protect your personal data is set out in our Privacy Policy, which forms part of these Terms. By submitting the entry form you confirm that you have read and understood the Privacy Policy.

10. Acceptable use

When using this website you agree:

  • not to submit false, misleading or fraudulent information;
  • not to use the website to attempt to gain unauthorised access to our systems, vendor data or other entrants’ data;
  • not to use the website in any way that breaches applicable law or our Small Society Lottery licence conditions;
  • not to attempt to enter the same paper ticket more than once.

We reserve the right to void entries, refuse service or refund tickets where we reasonably believe these terms have been breached.

11. Complaints and disputes

If you have a complaint, please email us first — we’ll come back to you the same working day where possible. Our complaints email address is [email protected].

If your complaint is about the conduct of the lottery itself and we are unable to resolve it directly, you may refer it to an approved Alternative Dispute Resolution provider such as the Independent Betting Adjudication Service (IBAS) (ibas-uk.com).

You may also raise concerns about us with our Scottish licensing local authority (which issued our Small Society Lottery licence) and, where relevant, with the Gambling Commission (gamblingcommission.gov.uk).

12. Liability

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be limited under UK law.

Subject to the paragraph above, our total liability arising in connection with the Dementia Lottery and these Terms is limited to (a) the cost of the ticket(s) you bought from us, plus (b) the advertised prize, where you are the validly drawn winner. We are not liable for indirect, consequential or special loss; for loss of profit, business, opportunity, goodwill, anticipated savings or data; or for any loss arising from your failure to provide accurate registration details.

13. Responsible play

The Dementia Lottery is a small-society community fundraising lottery. It is meant to be enjoyed in moderation. Please play responsibly. If gambling is having a negative impact on you or someone you know, free, confidential support is available from:

  • GamCare — 0808 8020 133 — gamcare.org.uk
  • GambleAware — gambleaware.org
  • National Gambling Helpline — 0808 8020 133 (24 hours)

You can self-exclude by contacting us in writing — we will permanently remove your details from our entry and marketing lists.

14. Changes to these Terms

We may update these Terms from time to time — for example, to reflect changes in our operations, our providers, or the law. The current version is always available at this URL, and any material changes will be communicated by reasonable means before they take effect.

15. Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them are governed by the law of Scotland. The Scottish courts have non-exclusive jurisdiction to determine any dispute that is not resolved through the complaints procedure or by an approved Alternative Dispute Resolution provider.
